This website, sheltersandcanopies.co.uk, is operated by Shelters and Canopies, a trading name of Express Matting Services Ltd, a company registered in England and Wales (Company No. 07000887, VAT No. GB987256073), whose address is Unit 1B, Summit Works, Manchester Road, Burnley, Lancashire, BB11 5HG, United Kingdom. In these terms, “we”, “us” and “our” mean Shelters and Canopies (Express Matting Services Ltd).
These Terms of Service, together with our Shipping Policy, Refund Policy and Privacy Policy, apply to your use of this website and to any order you place with us. Please read them before ordering. By using the website or placing an order you agree to these terms. Nothing in these terms affects your statutory rights as a consumer.
1. Our products
We supply cycle shelters, compounds, canopies, walkways and related products. We make every effort to describe and show our products accurately. Colours on screen may vary slightly from the finished product. Many products are made to order to the options you choose. We may change product descriptions or discontinue products at any time, but this will not affect orders we have already accepted.
2. Orders
When you place an order you are making an offer to buy. We will email you to acknowledge your order; a contract is formed when we confirm acceptance by email. We may decline an order, for example if a product is unavailable or there is an obvious pricing error. If we cannot accept your order, we will tell you and refund any payment in full.
Please check your order and chosen options carefully before submitting, as made-to-order items cannot be changed once production has started. You can cancel free of charge before production starts — see our Refund Policy.
3. Prices and payment
All prices are in pounds sterling (GBP) and include VAT at the current UK rate. Delivery to UK addresses is free and is shown at checkout before you pay. The price you pay is the price shown when you place your order.
Payment is taken in full at checkout through Shopify’s secure, encrypted payment system. We accept the payment methods shown at checkout. We do not see or store your full card details. If you need a VAT invoice, contact us with your order number.
If we find an obvious error in a price after you have ordered, we will contact you to ask whether you want to continue at the correct price or cancel for a full refund.
4. Delivery
Delivery times are set out in our Shipping Policy and are estimates. We will keep you informed of your dispatch date. Risk in the goods passes to you on delivery, and ownership passes to you once we have received full payment.
5. Cancellations, returns and faulty goods
Your rights to cancel and return goods, and what happens if goods are faulty, damaged or not as described, are set out in our Refund Policy. If you buy as a consumer, you have legal rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, which these terms do not affect.
6. Installation and use
Unless your order states otherwise, products are supplied for you to install. Please follow the installation guidance supplied with your product and any applicable building, planning or site requirements. We are not responsible for loss or damage caused by incorrect installation, misuse or modification of the product.
7. Our liability
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for loss or damage that is not foreseeable. If you are buying for business purposes, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity, and our total liability to you is limited to the price of the order. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.
8. Website use and intellectual property
The content of this website, including text, images and design, belongs to us or our licensors. You may use the website for your own personal or business purchasing, but you must not copy, reproduce or republish its content without our written permission, or use the website for any unlawful purpose.
9. Third-party services
Our store is hosted by Shopify, and payments are processed by our payment providers. Any sale is made directly between you and us. The website may contain links to third-party websites, which we do not control and are not responsible for.
10. Your personal information
We use your personal information as described in our Privacy Policy.
11. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are the ones shown on this page when you placed it.
12. Governing law
These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of your home nation.
